The availability of medical cannabis patient status and card significantly improves the life quality of the patients suffering from chronic pain and a number of other debilitating pathologies. In accordance with the procedure prescribed by the law, patients applying for the medical cannabis program in Maine must have a diagnosis, confirmed by the certified doctor. The list of chronic and debilitating conditions, subject to the treatment with the use of cannabis, includes the following pathologies:
Any of the above diagnoses confirmed by a medical specialist participating in the MMJ ME program is the basis for granting a medical cannabis patient status.
Medical marijuana has been legal in Maine since 1999 when a referendum was held, and patients’ right to take cannabis was legalized in the treatment of a narrow spectrum of diseases. Nevertheless, already in 2009, a new law on medical marijuana entered into force. According to it, medical cannabis can be prescribed to the resident of Maine suffering from pathological diseases, the list of which expands periodically.
As for recreational cannabis, it became legal in the state only in 2016, when the retail sale of weed was legalized. In 2019, the governor signed the law “On the adult use of cannabis“, which introduced a number of amendments to the law on the legalization of marijuana. As of 2020, the purchase, storage, use, and cultivation of medical cannabis is regulated by the law of Maine. This guarantees every patient who needs medical cannabis a continuous access to it and the right to obtain it in sufficient quantity.
In Maine, if you are at least 21 years old and a resident of the state, the law permits you to grow cannabis at home for personal consumption. At that, there are following limitations on the number of plants planted simultaneously:
Seedlings are the plants up to 24 inches tall and 18 inches wide. You can grow cannabis either indoors (your real estate) or in open ground (your site or that of the third party with written consent). Meanwhile, your plants on the site must not be visible to strangers – only from an airplane or through binoculars. Every plant must be marked with a label indicating your name and a number of the driver’s license or ID. By law, the grower is permitted to keep cannabis at home in an amount not exceeding the harvest of three plants. You cannot harvest a new crop if the previous one has not yet been exhausted. In this, the patient has the right to give the excess of cannabis. However, he/she can’t sell it or exchange it for other goods.
Patients who participate in the ME cannabis program can buy cannabis in the special dispensaries. Points of sales are evenly distributed throughout the state. In 2019, the dispensaries of Maine sold cannabis worth over $26 million. At the same time, total sales are steadily increasing, as well as the amount of licensed retail points of sale. You can find the closest dispensary by using a map.
Any resident of the state aged 21 or older who has a pathology confirmed by the doctor’s recommendation can become a participant of the MMJ program. Minor patients also have the right to participate in the program, but an application is submitted only with the written consent of the parents/guardians. Documents confirming the status of the parent or guardian should be attached to the application from a minor. In this, a parent or guardian must simultaneously obtain the status of a caregiver as part of a medical marijuana program. Only the residents of Maine can participate in the medical cannabis program. When submitting an application to the Department of Health, you need to attach a copy of the ID card or driver’s license issued by the state of Maine. Members of the medical cannabis program are automatically exempted from criminal liability for the use and storage of cannabis. However, patients who practice driving while intoxicated should remember about the responsibility for this action. The same is true for smoking in a public place, which will also entail a fine or other statutory sanctions. And don’t forget that at the federal level, cannabis is still illegal and considered a drug.
A medical worker with such status as Medical Doctor, Nurse Practitioner or Physicians Assistant and is the resident of the state has the right to make a diagnosis and prescribe cannabis to the patient. If the medical practitioner considers that the treatment with cannabis will provide a significant therapeutic effect, he/she has the right to prescribe a recommendation, which will allow the patient to receive MMJ ME card.
Every patient has the right for a primary caregiver to obtain assistance in the use and cultivation of medical cannabis. The caregiver must be at least 21 years of age. In this, he/she must have a flawless crime past and not have a criminal record under a drug-related article. To obtain a caregiver status, you must be a resident of the state. Exceptions are the relatives of the patient or persons living in the same household as the patient. By law, a second caregiver may be appointed for a minor or incapacitated patient, as well as the patient registered with a nursing facility or hospice. The caregiver has the right to store up to 2.5 ounces of dry flower plants and cultivate up to 6 plants undercover. One caregiver can take care of no more than 5 patients. Moreover, the law provides for the possibility of receiving compensation for the caregiver services.
