California residents who are over the age of 18 and have health concerns qualify for an evaluation. If an evaluating physician finds that a patient’s symptoms and conditions qualify (see Question 10), then Medical Marijuana is recommended and the patient is legally allowed to purchase, possess and use Medical Marijuana.

Medical marijuana is legal in California when it is used for valid medical conditions. Your medical condition must be evaluated and verified by a doctor in order to qualify for a physician’s recommendation. The following is a list of qualifying medical conditions for the state of California under Proposition 215 also known as the Compassionate Care Act of 1996:

– Alzheimer’s Disease

– Amyotrophic Lateral Sclerosis

– Anorexia

– Arthritis

– Cachexia

– Cancer

– Crohn’s Disease

– Epilepsy

– Glaucoma

– Hepatitis C

– HIV/AIDS

– Lyme Disease

– Migraine

– Multiple Sclerosis (MS)

– Muscle Spasms

– Severe and Chronic Pain

– Severe Nausea

– Seizures

– Spasticity

– Other.

California’s Marijuana Medical Program (MMP) does allow for other qualifying conditions, such as “any other chronic or persistent medical condition that limits the ability of the patient to conduct one or more major life activities as defined in the Americans with Disabilities Act of 1990, or if not alleviated, may cause serious harm to the patient’s safety, physical, or mental health.”

The hard copy of the recommendation is an official legal document that allows you to use Marijuana legally. After obtaining the recommendation you should bring it to a dispensary or cannabis club for your first visit. After the first visit the MMJ-ID Card is typically all that’s needed. The MMJ-ID Card is a convenient way to identify you as having the legal right to use and possess Medical Marijuana. The MMJ-ID Card can provide you with peace of mind, as it provides documentation you may need in certain situations, such as traffic stops.

Under the law, eligible patients can possess six adult plants or 12 immature plants. However, because the California Supreme Court has ruled that the numbers of SB420 are arbitrary, patients can grow enough Marijuana to reasonably meet their medical needs. What this means is that if you grow a certain amount per month, you must personally consume that same amount.

Under the law, you may not sell or give away Medical Marijuana, nor may you possess it with the intent to sell it. Additionally you may not smoke Medical Marijuana:

In any place where smoking is prohibited by law

In or within 1,000 feet of the grounds of a school, recreation center, or youth center, unless the medical use occurs within a residence

On a school bus,

While in a motor vehicle that is being operated

While operating a boat.
