If a caregiver was designated directly on the patient’s written certification by the medical practitioner, they do not need to register or renew separately. However, if the caregiver’s role is not specified in the written certification, maintaining an active registration is required for them to continue purchasing or receiving medical cannabis on behalf of the patient.

Can I renew my Virginia medical marijuana certification online?

Yes. Patients can renew their medical marijuana certification online through a telemedicine appointment with a licensed Virginia practitioner. For medical marijuana, you can only pay a 5.3% sales tax. But recreational users also have to pay a 21% excise tax along with the sales tax.

Do you lose your gun rights with a medical card in Virginia?

The federal government views marijuana as illegal and the Virginia state has no specific law stopping MMJ cardholders from possessing firearms, making the situation complicated. But individuals with medical marijuana cards cannot own guns under federal law. The ATF will always ask if the gun purchaser is an unlawful marijuana user before providing a firearm license. Can you smoke marijuana in public with an MMJ card?

It is illegal for anyone to smoke or consume marijuana in public in Virginia, even if you have a medical marijuana card. Additionally, it is unlawful to offer it to someone else, whether they accept it or not. Is using medical marijuana a reason for labor discrimination?

Using medical marijuana is not a reason for labor discrimination and employees are protected from discrimination and termination. But employers don’t have to commit an act that will cause them to be in violation of federal law.

Can I use an out-of-state medical cannabis card in Virginia?

You cannot use an out-of-state medical cannabis card while in Virginia as it does not support a reciprocity program. This means that even if you have a valid medical marijuana card from another state, you cannot legally purchase medical cannabis from Virginia dispensaries.
