There are many challenges that veterans face after they leave the military. And it’s no secret that a significant number (around 44%) report of problems readjusting after their return.
Some of the most serious problems are health related. A considerable number of veterans have suffered traumatic brain injuries (TBIs), with about one in five experiencing a mild form of TBI commonly known as a concussion. Other common problems include posttraumatic stress disorder (PTSD), chronic pains, depression, anxiety, problematic alcohol use, and thoughts of suicide. Many veterans suffer from more than one health condition.
Of course, the Veterans Health Administration (VHA), which provides health care to a great number of veterans, offers more than decent care, but VA doctors cannot provide or recommend medical marijuana for veterans as the federal status for cannabis remains a Schedule 1 substance, making it illegal in the federal government’s eyes. However, since the normally prescribed slate of opioid, muscle relaxers and other drugs often left vets in a medicated stupor, many are increasingly turning to medical cannabis as an effective alternative. The survey conducted by The American Legion showed that 83% of veteran households surveyed indicated that they believe the federal government should legalize medical cannabis nationwide, and nearly 1 in 4 veterans self-reported using marijuana to alleviate a medical or physical condition, four-in-ten say that they “know a veteran” who is using cannabis medicinally.
Being aware of this trend, the head of the VA, Denis McDonough, noted in November 2021 that officials within the organization are “looking at” the possibility of an internal policy change regarding the VA and medical cannabis.
Here are some of the current pending legislations related to veteran cannabis use and the potential for VA cannabis prescription:
H.R.5977 – States Reform Act
Was introduced on 11/15/2021. The bill seeks to deschedule cannabis from the Controlled Substances Act but allow state regulation or prohibition, similar to alcohol.
H.R.3105 – Common Sense Cannabis Reform for Veterans, Small Businesses, and Medical Professionals Act
Introduced 5/11/21. This proposed bill would allow physicians to recommend, complete forms for or register veterans for participation in a treatment program involving medical cannabis as approved by the State or Indian Tribe laws.
H.R.2588 – Veterans Medical Marijuana Safe Harbor Act
Was introduced on 4/15/21. This bill would allow VA doctors to write a VA cannabis prescription to veterans in states that have established state-legal medical cannabis programs.
H.R.430 – Veterans Cannabis Use for Safe Healing Act
Introduced 1/21/21. This bill prohibits the VA from denying a veteran any VA benefit due to participation in a state-approved cannabis program, and allows VA physicians and other VA health care providers to provide recommendations to veterans who are residents of states with approved medical cannabis programs.
These are just several drafted laws emphasizing the importance of veterans cannabis projects and public recognition of the fact that our veterans deserve the option to legally access a botanical product that is objectively safer than the litany of pharmaceutical drugs it could replace.
